1.Scope of Services
These Terms apply across the full range of services we offer, including direct cremation, wake services, burial, memorial services, and international repatriation of remains to or from Singapore. The specific service, or combination of services, we provide to you is as set out in the Sales Agreement Form signed by you (or your authorised representative) for each arrangement. The Sales Agreement Form, together with any written quotation we provide and these Terms, forms the entire agreement between you and Farewell Funerals for that arrangement.
Any service, item or arrangement not expressly listed in the Sales Agreement Form falls outside our scope of services, and will be treated as an additional item to be separately quoted and agreed in writing before we proceed with it.
2.Quotations
Quotations provided by us are valid for 3 days from the date of issue, unless otherwise stated on the quotation.
Quotations are based on the information available to us at the time, including the religion, number of wake days, venue, and, for repatriation, the destination or origin country that you have confirmed. Prices may be revised, and a fresh quotation issued, if these details change or if the original quotation has lapsed.
3.Deposit & Payment Terms
A nominal deposit is payable upfront to confirm and commence an arrangement. This deposit is non-refundable once paid.
Full and final payment of all outstanding fees is due, and must be received by us, before the cortege departs on the day of the funeral, cremation, burial or repatriation — unless we have otherwise agreed with you in writing.
We accept payment by the methods stated on your invoice. Where third-party disbursements (such as columbarium niches, religious offerings, or airline cargo charges) are payable to a third party directly by you, we will inform you of this separately.
4.Late or Outstanding Payment
If full payment is not received by the time stated in Section 3, we reserve the right to withhold the commencement or completion of the service, including the departure of the cortege, until payment is settled or an alternative written arrangement is agreed. We also reserve the right to charge interest on overdue amounts, and to recover any reasonable costs of collection, to the extent permitted by law.
5.Cancellations & Changes
Should you need to cancel or materially change an arrangement after signing the Sales Agreement Form, please inform us as soon as possible. The deposit paid is non-refundable, as stated in Section 3. Where we have already incurred costs or made commitments to third-party vendors, government agencies or venues on your behalf, those additional costs will also remain payable by you.
6.Third-Party Vendors
In the course of an arrangement, we may refer or introduce you to third-party vendors — including but not limited to florists, caterers, transport and hearse providers, religious officiants, embalmers, columbaria, crematoria, printers, and overseas funeral homes or receiving agents — for your convenience.
These third-party vendors are independent contractors and are not our employees, partners or agents. While we take reasonable care in referring vendors we have worked with before, we make no representation or warranty as to, and accept no liability for, the quality, timeliness, conduct or performance of any third-party vendor's goods or services. Any arrangement, contract or dispute you have with a third-party vendor is between you and that vendor, and is governed by that vendor's own terms.
7.International Repatriation Services
Where our scope of services includes the repatriation of remains to or from Singapore, our responsibility is limited to the arrangements described in your Sales Agreement Form, and to preparing the deceased, the casket and the associated documentation up to the point of handover for carriage.
For repatriation out of Singapore, our responsibility ends once the casket has been formally handed over to the appointed freight forwarder and/or airline at Singapore Changi Airport. From that point on, the freight forwarder and the airline are solely responsible for the carriage, handling and delivery of the remains to the destination country.
We do not indemnify, and accept no liability for, any loss, damage, delay or other incident that occurs after this handover, including during air or ground transport, customs clearance, or handling by the freight forwarder, airline or any receiving agent overseas. Any claim arising from an incident after handover should be directed to the freight forwarder or airline responsible, in accordance with their own terms and applicable international carriage conventions.
The same principle applies in reverse for repatriation into Singapore: our responsibility for the arrangement begins once the casket has been formally handed over to us, or to our appointed representative, at Singapore Changi Airport (or the relevant port of entry), and we are not responsible for the carriage or handling of the remains prior to that point.
8.Client Responsibilities
You agree to provide us with accurate and complete information, and any documents we reasonably request (such as identification, death certificates or family instructions), in a timely manner. Delays in providing information or documents may affect our ability to meet timelines, including statutory, airline or embassy requirements, and we will not be responsible for delays caused by incomplete or late information provided by you.
9.Limitation of Liability
To the fullest extent permitted by law, our total liability to you arising out of or in connection with any arrangement, whether in contract, tort (including negligence) or otherwise, shall not exceed the total fees actually paid by you to us for that specific arrangement.
We shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of a non-financial nature, arising from circumstances beyond our reasonable control, including the acts or omissions of third-party vendors, freight forwarders, airlines, government agencies, embassies, or venues, or any loss occurring after handover as described in Section 7.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Singapore law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
10.Force Majeure
We shall not be liable for any failure or delay in performing our obligations where this is caused by events beyond our reasonable control, including but not limited to natural disasters, epidemics or pandemics, government restrictions, industrial action, or disruption to transport, embassy or airline operations.
11.Photography & Privacy at Services
Where photography, videography or livestreaming is arranged as part of your package, it is provided solely for your family's private use unless otherwise agreed with us in writing. Please refer to our Privacy Policy for how we handle personal data collected in the course of an arrangement.
12.Complaints
If you are unhappy with any aspect of our service, please contact us as soon as possible using the details below, so that we can address your concerns promptly and informally in the first instance.
13.Intellectual Property
All content on our website and marketing materials, including text, images and logos, is owned by or licensed to Farewell Funerals Pte. Ltd. and may not be reproduced without our prior written consent.
14.Amendments to These Terms
We may update these Terms from time to time. The version applicable to your arrangement is the version in force at the time you sign the Sales Agreement Form, unless we notify you of a change in writing.
15.Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16.Entire Agreement
These Terms, together with the Sales Agreement Form and any written quotation issued to you, constitute the entire agreement between you and Farewell Funerals Pte. Ltd. in relation to the services provided, and supersede any prior discussions or representations, whether oral or written.
17.Dispute Resolution & Mediation
If a dispute arises between you and us in connection with an arrangement or these Terms that cannot be resolved informally under Section 12, both parties agree to first attempt to resolve the dispute through mediation — for example, through the Singapore Mediation Centre or another mutually agreed mediator — before commencing any court proceedings.
Mediation will be conducted in Singapore, in English, and each party will bear its own costs of mediation unless otherwise agreed. If the dispute is not resolved through mediation within 30 days of a request to mediate (or such longer period as the parties may agree), either party may then proceed to the courts as set out in Section 18.
18.Governing Law & Jurisdiction
These Terms are governed by the laws of Singapore. Subject to Section 17, any dispute arising out of or in connection with these Terms that is not resolved through mediation shall be subject to the exclusive jurisdiction of the courts of Singapore. Nothing in these Terms is intended to prevent either party from seeking urgent interim relief (such as an injunction) from the courts at any time, or to remove any right a consumer may have to bring a claim before a statutory tribunal where mediation or court exclusion cannot lawfully apply.
